Datsun Matsuri travel "Incident"

Post by ted heaton »

Under the direction of Ross, the West Coast BC roadster folks joined up to caravan to Kelowna for the show.
Excessive driving "enthusiasm" by some caravan members lead to an encounter with law enforcement officers.
As per the excessively harsh traffic regulations, speeds of 40KPH over the posted limit can result in confiscation of keys and vehicle!.
The offender (actually 2, but the second has been more discrete concerning the event so his identity will not be revealed)
was sure he was taking the bus to Kelowna but he had his wife along and the officer knew he would be hearing about this
frequently from the wife and that would be sufficient punishment.
After the issuance of a substantial ticket the caravan was allowed to continue.
Needless to say this provided substantial amusement to all the show participants.

Ted.

Wow, that's TERRIBLE, yes definitely grounds to have it thrown out, it's proof the cop was an idiot!
Didn't he/she require a registration where the correct info was printed??

Oh bummer dude! I don't think too many people will beat my road trip ticket hx when living in So Cal... 2 tickets in three days, three in two weeks! Got one just before Shasta, one on the way (airplane, cop said he couldn't write me a warning for 90mph, but was kind and made it 70 and had a good sense of humor), and one on the way back... doh! You would think I would learn (but even today I continue to "travel" as I put it when going to Shasta... the Mightly U is soooo happy at 90 in 5th).

One ticket (the 70/90) I had to pay; the third I told them I had a speedo issue, and they said they would drop it if I sent a repair record... which I did (ha, not that it was real, but they bought it!), and the other I had to go to traffic school for in Long Beach. I'm not reckless, just like to move and I don't feel comfortable unless I'm passin cars. BTW, the Staters here are running some unusual cars these days, including totally unmarked and off color SUVs, and Honda Accords... bastards! And I've given up on my old Passport (died) and it never really saved me from laser. Perhaps the (soon to be) new wife will slow me down a bit. But don't count on it!

1. You can definitely get it thrown out for the wrong car being listed on your ticket; not just model, the whole make is wrong! Everyone one knows we have a COPY of that car.

2. $196 looks pretty good from where I'm sitting in Los Angeles. 8) Here you pay the ticket AND do "8 hour" traffic school.

Yes, it does say 1965......The plate on the car says 1966, but looks like the last 6 was stamped over a 5. The registration/insurance has it listed as a 1965.......(Datsun not MGB)
It is SPL311-1605 so an early 1600, it could be a 65 model that was re-stamped. When I got it, it had a 1500 dizzy and a container style oil filter.........

Daryl;

Because they have the make and model wrong, you might be able to fight it. I think you'd have to go to Penticton to fight it (2nd Road trip??). Maybe you can photocopy the ticket and your registration and send them a letter. They might just drop the whole thing.

Did you check with Mitch to see what they identified his car as?

Jim

I think the judge will ask if YOU were going too fast. The type of car might be an immaterial detail. And there is the part where you would probably have to travel all the way back to go to court. There is also the possibliity that the judge will be some kind of Philistine who will say, "That's the same as an MGB isn't it?"
I always figured that if I averaged the few times I got caught with the times I drove too fast, it was pretty cheap.

Was the incident on the Hope-Princeton or the Coquihallla?

Last weekend I was travelling back to Vancouver on the Coquihalla and passed a bogus construction zone c/w several police vehicles and at least three tow trucks parked ready to transport impounded vehicles. Luckily we were traveling in the opposite direction but stopped and watched several cars get pulled over. Talk about entrapment, the trap was set up on the longest, straightest section, normally posted 110 kph but was posted at 80 kph as a construction zone. I don't condone high risk driving but WTF is the point on a Sunday with very light traffic.

Is compliance or revenue generation the objective? :x

Not that an almost $200 ticket is chump change, but around Cali, it probably is close to, if not more than triple that by the time you figure "court fees" and traffic school, not to mention what will happen to your insurance once then find out.

If the ticket says MG then you will win. The whole point of contesting a ticket is to show the officer was unable to perform the duties of his job at an acceptable level. If he cant read the registration, or figure out the type of vehicle, how can he be counted on to accurately calculate the speed you were traveling.

Don't offer any information about how fast you thought you were going. It's not about you, it's about the cop who can't read.

Good luck.
